Section 1 – Scope of the Terms and Conditions

These Terms and Conditions are applicable to all deliveries, services, and offers provided by Taste Factory Pty Ltd (referred to as “Taste Factory”) through this online shop on a contractual basis. By using the Taste Factory website, you agree to adhere to these Terms and Conditions. Any references to the purchaser’s own terms and conditions will not be acknowledged. Deviations from these terms and conditions are only valid if confirmed in writing by Taste Factory.

We retain the right to modify the terms of this agreement. Continued use of the Taste Factory website after any changes have been posted indicates your acceptance of the modified terms.

Section 2 – Offer and Contract

All offers are subject to change. Information provided on this website is without guarantee. We reserve the right to make technical changes and are not liable for typographical errors. Items are presented without decoration. Taste Factory reserves the right to make design or technical changes. Manufacturing variations of up to 5% at the top and bottom of the range are possible. Orders are considered accepted only if confirmed in writing by Taste Factory. The order acknowledgment sent by the shop system via email serves as a summary, not as automatic acceptance. An order is accepted if no contrary information is provided within 5 working days after order receipt and/or dispatch of the ordered goods.

Order processing and communication primarily occur via email and automated systems. Customers are responsible for providing a correct email address for order processing. When using SPAM filters, customers must ensure receipt of all relevant emails.

Section 3 – Returns

All returns must be approved by the seller. Shipping costs (both ways) are non-refundable. A copy of the purchase or delivery document should accompany returns. Goods should be well-packed for collection. Taste Factory is not liable for losses or damages and recommends shipment insurance. Returned goods should be in original packaging and AS NEW condition.

Taste Factory stands firmly behind its products. If dissatisfied, customers meeting the conditions of the 30-day test use policy can receive a full refund. Refunds are granted within 30 days from the delivery date. To initiate a return, customers should notify Taste Factory within 30 calendar days from delivery. The aim is 100% customer satisfaction.

Please Note:

In the event of returning an order:

  • Devices must be unused.
  • Items must be clean.
  • Protective films must be intact.
  • Returns are not accepted for used, damaged, or unclean items, or devices without packaging.
  • Taste Factory may charge full retail rates for damages.
  • Full store credit is given for items in original undamaged packaging.
  • Unopened, unused, and resalable items are eligible for return and refund.
  • Special order items cannot be returned.
  • Shipping costs (both ways) are not refunded.
  • Taste Factory recommends insuring shipments.
  • Goods customized to customer specifications, perishable items, or items unfit for return are excluded from revocation.

Section 6 – Payment

Payment on the Taste Factory online shop can be made via Paypal, credit card, or account. We reserve the right to accept or exclude certain payment methods, e.g., payment in advance, on an individual basis. Payment by Paypal charges the customer’s Paypal account after a successful order, and goods are shipped. Payment by credit card charges the customer’s credit card account after a successful order, and goods are shipped. Payment in advance requires immediate payment upon order acknowledgment and is shipped upon payment receipt. In case of payment default, a 1% monthly interest and a 5.00 AUD reminder fee may be charged. Debt collection agency costs are at the purchaser’s expense if contracted.

Section 7 – Reservation of Property

All items supplied remain Taste Factory’s property until full payment is received. In case of arrears, Taste Factory can demand item surrender. Payments made up to 40% of the purchase price can be retained for cost compensation. If no part-payments were made, compensation to the amount of 40% of the purchase price is claimed. Delivery and removal costs are separate.

Section 8 – Warranty

Your rights under the Australian Consumer Law (ACL) are not limited or excluded by these Conditions of Sale. Manufacturer’s warranty may also apply. The purchaser has the right to demand improvement for defective parts. Warranty period is 1 year for private customers. Shipping costs to and from buyers are not reimbursed. Taste Factory does not guarantee damage due to misuse, loss of parts, environmental factors, non-compliance with instructions, etc. Wear and tear parts are not covered. Taste Factory is not liable for damages to stock goods. Guarantee claims are non-transferable. Notification of defects must be made within  14 days after receipt. Goods are considered accepted after this period.

Section 9 – Compensation

If the purchaser does not accept goods or fulfill cooperation obligations, Taste Factory can withdraw from the contract and demand 40% compensation. Damages exceeding this amount may also be claimed.

Section 10 – Transfer of Risk

Risk transfers when shipment is handed to the carrier. If shipment is impossible through no fault of the vendor, risk transfers when goods are ready for dispatch.

Section 11 – Acceptance of Goods/Transport Damage

Purchasers must inspect packaging and goods upon receipt. Transport damage must be confirmed immediately. Otherwise, transport damage costs are borne by the purchaser.

Section 12 – Limitation of Liability

Liability is limited to deliberate or grossly negligent actions. Consequential damage liability is excluded.

Section 13 – Partial Nullity

If a provision is invalid, the content is applied analogously. Invalidity of one provision does not affect the validity of others.

Your personal data are protected according to statutory provisions. Information on data collection, processing, and use can be found in our data protection policy.

User Comments, Feedback, and Other Submissions

By submitting content, you grant Taste Factory rights to use, edit, publish, and distribute. We have no obligation to maintain comments confidentially. We are not liable for third-party materials or websites.
